Declaration On Commemoration of the 2nd Year Indian Illegal Military Siege of Jammu Kashmir
Today on the 5th August 2021 is the second year of the Abrogation of Article 370 and 35(a) of the Indian Constitution which essentially is the revocation of the special status of Jammu and Kashmir.
We the Malaysian civil society and political members register our concern and our stance on the issue of the India illegal occupation of Kashmir and call for the intervention of the International community to pressure India for the freedom and the right for self determination for Kashmir.
We state our stance that :
CONFIRMING that India’s unilateral revocation of Jammu Kashmir autonomy status is indeed rooted from the invasion and occupation of India on Kashmir . The revocation entailed that the territories are placed under emergency law and its autonomy status revoked.
OUTRAGED by the decision taken by the BJP Government which also witnessed the deployment of tens of thousands of troops into the territories of Jammu and Kashmir , the arrests of political leaders , the assault on civilians including children and women and lockdown of communication are violation of local and international laws..
RECOGNIZING what India did after the aborgation was not really a lockdown but in actual fact a siege.
REALISING that the consequences of the abrogation of the Article 370 and 35 (A) with the subsequent suppressive measures taken by the Indian authorities has impacted gravely on the livelihood of the Kashmiris.
SERIOUSLY concern of the dire situation of Kashmiris until today , especially amongst vulnerable segment of the Jammu and Kashmir population ; children , women , youth and the elders who are exposed to the inhumane treatment by the Indian occupation troops , atrocities of extrajudicial killings ,fake encounters , rape , blinding by pellet guns, arbitrary arrest , torture, demolition of homes , incarceration of youth and political dissenters.
TAKING NOTE that the Kashmiris have undergone and are still continously enduring tremendous sufferings under the illegal occupation of India. The enaction of the Domicle Law aim to initiate a demographic change in Jammu and Kashmir will create communal tention and deny the local rights of the Kashmiris to retain their citizenship.
AWARE of the farcist BJP government agenda of the Hindutva ideology that plans to convert Jammu and Kashmir into a Hindu majority province.
REITERATING when Jammu and Kashmir’s autonomy was revoked , oppression and persecution of the people were real and no international intervention was forthcoming.
DESPISED by the statement from a senior Indian diplomat unabashedly and publicly declared the need for Delhi to adopt an “Israeli model” in the Indian-administered Kashmir is atrocious .
CONFIRMING that utilising the Israeli model , of which atrocities and the genocidal actions the Tel Aviv regime has committed against the Palestinians are a recognised crimes against humanity. Proposing that India refer to Israel on how to oppress the Kashmir is in itself complicit with crimes in violation of international law. Indian troops under the New Delhi administrative is reported to have committed violations of human rights which had appeared in numerous international media and agencies.
REAFFIRMING that the right to self determination is the right of the people of Kashmir in accordance with the UN Universal Declaration of Human Rights and the 4th Geneva Convention,
AWARE of the UN Security Council Resolution 47 on the 21st April 1948 on the disputed territory of Jammu and Kashmir that an impartial plebiscite must be conducted for the people of Kashmir to decide their own future .
OBSERVING that the unresolved dispute over Kashmir if not attended will be a potential human catastrophe and a threat to regional stability.
We demand :
1. The unilateral revocation of the Article 370 and 35 (a) be nullified and the special status of Kashmir be restored.
2. The right to self determintation for Kashmiris must be upheld and a free plebiscite must be conducted in accordance with the UN Resolution.
3. Kashmir normalcy of livelihood must be reinstated and all the draconian laws imposed must be repealed and miltary operation halted.
4. India must withdraw all its troops from Kashmir and those responsible for human rights violations and crimes against humanity must be prosecuted in the court of law. Allow a full investigation on the atrocities perpetrated by the India occupying forces and bring those responsible to justice.
5. India must release immediately and unconditionally all Kashmir political detainees and youth held in custody.Those charged must be given access to legal consultation and must be protected from abuse of the law by the Indian authorities.
6. Allow a full investigation by an international independent body on the atrocities perpetrated by the India occupying forces since the Abrogation of the article 370 and 35 (A).
