DEMAND FOR THE RELEASE OF YASIN MALIK AND ALL HURRIYAT LEADERS

Memorandum

To

Secretary General of UN

Secretary General of OIC

OIC Member State Leaders

On the occasion of the Kashmir Day 2021 we are urging the UN, OIC and leaders of the world to put pressure on India to release immediately Yasin Malik who has been languishing in Tihar Jail of India.

We take note that the fascist regime of India is using the judiciary as a tool to crush all resistance movement to liberate Kashmir lead by Yasin Malik.

Chairman Jammu and Kashmir Liberation Front Yasin Yasin Malik, is leading a non-violent political resistance against the occupation of Jammu and Kashmir.

His incarceration in the death cell of the notorious Tihar Jail since May 7, 2019, cannot be tolerated by the international community.

He was arrested from his residence in Srinagar under a Public Safety Act (PSA), a draconian and oppressive legal instrument which India applies with impunity against Kashmir.

He is clearly a victim of political repression by the Indian authorities through the notorious Terrorist and Disruptive Activities (Prevention) Act) court (TADA).

He is maliciously framed by the India farcist government to curb his freedom as a voice of conscience for the Kashmir cause.

Yasin Malik’s only sin is because of his stance towards the Indian government.

Hurriyat leaders are targeted including Yasin Malik for their political ideology and struggle to regain the sovereign rights of his people.

His life has been unjustly robbed for the last 35 years for his stance on the Independence of Kashmir.

We call on the Malaysian Prime Minister to convey to the India government to release Yasin Malik under the human rights provision in the international law.

Malaysia must be courageous to make a firm stand on the injustice and violation of human rights by the Indian farcist regime.

The fabricate cases on Yasin Malik failed to stand if the court is free. This is why the Indian government is applying its draconian laws not to put on trial for justice but to crush all political dissent from the Kashmiris.

The concorted and engineered cases of allegations against him for “terror funding” is a show of desperation by the India authority to justify the death sentence planned by the court.

The brutality of the notoriuos jail seems to be insufficient to relent Yasin Malik’s resolve to affirm his commitment to the Kashmir cause.

Using judiciary as a tool to intimidate Yasin Malik and other Hurriyat leaders, is the only way the Indian regime will justify that their cases were ruled by due process of the law.

We reaffirm that hiding behind a partisan court system will expose the cruelty of the regime.

The denial of Yasin Malik to meet his wife and eight year old daughter Razia Sultana since September 1, 2014 is nothing less than a display inhumanity and zero compassion.

Compounded by the mental and physical torture he has to endure in the 5 by 7 feet prison room of the prison with a size of 5 by 7 feet with an open toilet , his incarceration has only one aim, to break him.

We express pur deep concern on the report from his wife , Mushaal Mullich that the extremely contaminated environment has further aggravated his already weak health.

We condemn the way the Indian authorities has ignored his ailments related to his vital organs of his body including both his kidneys and metallic heart valve, which needs certain life-saving drugs which are not being given to him.

This is outrageous . No inprisonned individuals should be denied of the necessary health care in the custody of the authority waiting for trial.

We firmly believe that the Geneva Conventions, the International Covenant on Civil and Political Rights, the Convention against Torture and Other Cruel, inhuman or Degrading Treatment and Punishment, as well as customary international law codified in Standard Minimum Rules for Treatment of Prisoners adopted by the United Nations General Assembly and Security Council in Yasin Malik case have been violated by the India authorities.

Victimizing Yasin Malik will not surrender him and the other prisonners of conscience to the barbarity of the Indian regime.

The Indian determination to eleminate him and the other Hurriyat leaders will not succeed.

We call for his immediate and unconditional release. He must be given the right to be treated for his ailments without delay.

We call all our Malaysian Ngos to rally for Yasin Malik’s and all Hurriyat’s leaders to be immediately released.

We urge all mosques in the country to read a special Friday sermon and prayers on the subject of the Kashmir struggle.

We demand for the international community to pressure India to protect their rights as prisoners of conscience .
